Judge Delivers Jarring Message to Same-Sex Parents About Biology and Parenthood

INJOAn Indiana judge had blunt words for the same-sex couples challenging a state law that prohibits the government from recognizing opposite-sex parents on birth certificates.

“You can't overcome biology,” U.S. District Court Judge Diane S. Sykes said, according to USA Today. Attorney Karen Celestino-Horseman, who represented the eight same-sex couples filing the suit, tried arguing that biological sex no longer determined parenthood. But Sykes said that argument belonged in debates by the state legislature rather than in the courts.

“If the state defines parenthood by virtue of biology, no argument under the [Constitution's] Equal Protection Clause or the substantive due process clause can overcome that,” Sykes also said in an apparent reference to using the federal Constitution to override state law.
